072- Application for Review of Num. 333 of the UN Administrative Tribunal
The International Court of Justice (ICJ) has been requested to give an advisory opinion on the decision of the Secretary-General of the United Nations to extend the appointment of a staff member beyond the expiry date of his fixed-term contract, on the grounds that the staff member was seconded from a national administration, that the secondment had ended and that his contract with the United Nations was limited to the duration of the secondment.
This decision was confirmed by the UN Administrative Tribunal. The staff member concerned subsequently turned to the Administrative Tribunal’s Requests for Reversal of Judgements Committee, which requested the Court to give an advisory opinion on the merits of the decision.
The Court delivered its advisory opinion on May 27th, 1987. It concluded that the decision taken by the UN Secretary-General did not violate any provision of the UN Charter and that, moreover, fairness had been respected.
