057- Application for Review of Judgment num. 158 of the UN Administrative Tribunal

On July 3rd, 1972, the International Court of Justice (ICJ) received a request for an advisory opinion from the Committee on Requests for Reversal of Judgments of the Administrative Tribunal. In the present case, a former UN official had challenged the decision of the General Secretariat not to renew his fixed-term contract before the Administrative Tribunal of the Organization.

As the Administrative Tribunal ruled in favour of the employer in judgment number 158 dated 28 April 1972, the civil servant submitted a request for a review of this judgment to the Committee of Requests for Reversal of Judgments of the Administrative Tribunal. The Committee itself turned to the ICJ for a ruling on the legality of the matter.

The Court gave its opinion in a decision of July 12th, 1973 and held that, contrary to the arguments of the staff member concerned, the Tribunal had not failed to exercise its jurisdiction and had not committed an essential error in the proceedings causing a mistrial.
